Referred to as "applicant."
1) Proprietary Information
Applicant recognizes that Applicant may have access to Company's client records, financial records, business forms and the list of Company's customers and Applicants. Applicant understands that all such information is a valuable and unique asset of Company's business and agrees to consider all such information to be proprietary.
Applicant agrees, at all times and all circumstances, to keep such information confidential. Applicant understands that this commitment survives the termination of Applicant's relationship with Company.
2) Solicitation
Applicant agrees that during the period of work assigned by Company and for a period of one (1) year after the termination of Applicant's work assignment(s), Applicant will not, on behalf of Applicant or any other individual or entity, call on any of the clients of Company for the purpose of soliciting or providing senior citizen domestic care services.
Applicant shall not directly or indirectly solicit, divert, or take away any client of Company, nor perform services for such clients during the stated period.
Applicant agrees not to seek employment with any home care agency within a 50-mile radius of Fargo Care Solutions LLC for at least 6 months after termination. Failure to comply may result in a minimum $10,000 penalty and possible legal action.
3) Position Duties, Procedures, and Responsibilities
Applicant agrees and certifies having at least 1 year of prior experience and training in Personal Caregiver duties including: Companionship & Conversation, Bathing, Dressing, Grooming, Light Housecleaning, Alzheimer's & Dementia Care, Meal Planning and Preparation, Running Errands, Medication Reminders, Laundry and Linen, Incontinence Care, and Reloading a Feeding Tube.
If Company discovers false information regarding experience, Applicant may be dismissed.
Applicant agrees to perform all duties listed above and travel within the service areas (York, Adams, Cumberland, Dauphin, Lancaster, Lebanon, and Schuylkill counties) for assignments of at least two hours per day.
Applicants working with Office of Long-Term Living (Medicaid Waiver) clients acknowledge working conditions on holidays including: New Year's Day, Memorial Day, July 4th, Labor Day, Thanksgiving, Christmas Eve, and Christmas Day.
*Pay Policy: Normal rate may be reduced to $10/hr, with time-and-a-half ($15/hr) paid as per law.
Applicant understands Company operates 24x7 and agrees to be contacted anytime regarding assignments. Applicant agrees to keep contact information updated.
Applicant understands this role involves non-medical care services and requires flexibility in scheduling, including on-call duties.
Applicant agrees to work assigned shifts (up to 40 hours/week) within the service area, with no guaranteed weekly hours. Schedule changes may occur on short notice.
Company is not responsible for providing consistent weekly hours.
4) Medicaid Waiver Compliance
I attest that, in accordance with CHC Waiver Appendix C, I am not a spouse, legal guardian, representative payee, or power of attorney for any client participating in the Medicaid Waiver Program.
